These terms govern SiteDatum, software created and operated by Francisco Cabrera as an individual developer. By installing, accessing, or using SiteDatum, the user agrees to these terms. Rights that cannot legally be waived remain unaffected.

The product

SiteDatum is single-user, local-first Windows project-engineering software. It helps organize records and ordinary Windows files but does not replace professional judgment, contractual notice requirements, an official document-management system, or independent backups. The customer remains responsible for project decisions, professional obligations, source documents, and backup practices.

Free and Pro

Free supports up to three active projects and the complete manual workflow without requiring an account. Pro is a paid subscription that allows unlimited active projects and provides templates, bulk operations, advanced interchange, professional outputs, and other workflow acceleration described at the time of purchase.

Subscriptions and renewal

Pro Monthly and Pro Annual renew automatically until canceled. The hosted checkout displays the price, billing interval, renewal behavior, and merchant terms before purchase. Stripe Managed Payments is the intended merchant of record for eligible transactions. Customers manage payment methods and subscriptions through Stripe-hosted surfaces; SiteDatum does not store full payment-card information.

Devices and connectivity

One individual Pro subscription supports two active Windows computers. A verified entitlement may continue temporarily during a service or network outage under the published 21-day verification-grace policy. Grace does not extend a paid-through date after authoritative expiration is known.

Cancellation and expiration

Customers can cancel through the hosted customer portal. Cancellation retains Pro access through the paid-through date unless applicable law or the merchant’s transaction terms require a different result. Expiration does not delete, hide, move, or make existing records uneditable. Existing records, backup, recovery, and an essential machine-readable export remain available. Free limits apply to creating or restoring active projects and to future use of Pro-only acceleration features.

Files and backups

Project documents remain normal Windows files controlled by the customer. SiteDatum does not silently overwrite, delete, or move files. Customers should maintain independent, tested backups and verify exports needed for contractual or regulatory recordkeeping.

Acceptable use

Users must not interfere with licensing or security controls, obtain access to another customer’s account, distribute malicious or unauthorized copies, use the software unlawfully, or represent SiteDatum as a substitute for professional judgment or contractual compliance.

Updates and availability

SiteDatum may correct defects, improve security, or change features over time. Material changes to pricing or these terms will be identified before taking effect when notice is appropriate. Local Free workflows and existing-record access are designed not to depend on continuous service availability.

Warranty

To the maximum extent permitted by law, SiteDatum is provided “as is” and “as available” without express or implied warranties, including warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. SiteDatum does not warrant uninterrupted or error-free operation or that the software satisfies a particular contractual, professional, or regulatory requirement.

Limitation of liability

To the maximum extent permitted by law, SiteDatum and Francisco Cabrera are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, or business opportunity arising from use of the software. Aggregate liability for a claim related to Pro will not exceed the amount paid for SiteDatum Pro during the 12 months before the event giving rise to the claim. This limitation does not apply where prohibited by law.

Disputes and governing law

Before filing a claim, the user agrees to contact supportsitedatum@protonmail.com and allow 30 days for informal resolution. These terms are governed by the laws of Florida, United States, without regard to conflict-of-law principles. Any court proceeding must be brought in a state or federal court with jurisdiction in Florida, unless applicable law requires another forum or provides rights that cannot be waived.
